METHODS OF PROCESSING

The Data Controller processes the Data of Users in a proper manner and shall take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.

The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Data Controller, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of the site (administration, sales, marketing, legal, system administration) or external parties (such as third party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. 1.2 Some features like searching a contact from the search bar require access to your Address book. This is required for the only purpose to provide the user the ability to search a contact in the Application. No data from your Address Book is collected, shared or sent in any way on the net.

1.3 This Application may track Users by storing a unique identifier of their device, for analytics purposes or for storing Users’ preferences.

2. IP ADDRESSES AND COOKIES

2.1 Information collected automatically from this Application (or third party services employed in this Application) can include: the IP addresses or domain names of the computers utilized by the users who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the User, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User’s IT environment.

2.2 We may collect some device information, including where available your IP address, operating system, the referring URL, if any, for system administration and to report aggregate information to our advertisers. This is statistical data about and does not identify any individual.

2.3 For the same reason, on this website, we may obtain information about your general internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer’s hard drive. They help us to improve our site and to deliver a better and more personalized service. 3. PLACE OF PROCESSING

3.1 The Data is processed at the Data Controller’s operating offices and in any other places where the parties involved with the processing are located. For further information, please contact the Data Controller.

3.2 The Data is kept for the time necessary to provide the service requested by the User, or stated by the purposes outlined in this document, and the User can always request that the Data Controller suspend or remove the data.

3.3 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to us; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

The Data concerning the User is collected to allow the Owner to provide its services, as well as for the following purposes: Analytics, Hosting and backend infrastructure, Displaying content from external platforms and Contacting the User.

5.3 Where Our Apps contains links to third-party content, applications, services and/or advertising, we are not responsible for the privacy policy or for any matters relating to such third party products, promotions or advertising, including responsibility for controlling any personal data that you may provide in response to such products, promotions or advertising. Additionally, if you are under 18 years old, you must obtain the permission of your parent or guardian and the person who pays your mobile phone bills (if different) and they must agree to these Terms on your behalf before you use Our Apps and before you provide any personal information to us. 6.5 Your access to the Services may be deleted or blocked without warning if it is found that you are misrepresenting your age or the age of the person using Our Apps. In this case, your membership account and all related data may be deleted without warning. Your access to the Services is solely for your personal use, and you must not authorize others to use your account.

Registration and authentication

By registering or authenticating, Users allow Smart Launcher to identify them and give them access to dedicated services.Depending on what is described below, third parties may provide registration and authentication services. In this case, Smart Launcher will be able to access some Data, stored by these third-party services, for registration or identification purposes.Some of the services listed below may also collect Personal Data for targeting and profiling purposes; to find out more, please refer to the description of each service.

Firebase Authentication (Google LLC)

Firebase Authentication is a registration and authentication service provided by Google LLC. To simplify the registration and authentication process, Firebase Authentication can make use of third-party identity providers and save the information on its platform.Personal Data processed: email address.

Content performance and features testing (A/B testing)

The services contained in this section allow the Owner to track and analyze the User response concerning web traffic or behavior regarding changes to the structure, text or any other component of this Application.

Firebase Remote Config (Google Inc.)

Firebase Remote Config is an A/B testing and configuration service provided by Google Inc.Personal Data collected: various types of Data as specified in the privacy policy of the service.

Hosting and backend infrastructure the user

This type of services has the purpose of hosting data and files that enable this Application to run and be distributed as well as to provide a ready-made infrastructure to run specific features or parts of this Application. Some of these services work through geographically distributed servers, making it difficult to determine the actual location where the Personal Data are stored.

DigitalOcean (DigitalOcean Inc.)

DigitalOcean is a hosting service provided by DigitalOcean Inc.Personal Data collected: various types of Data as specified in the privacy policy of the service.

For operation and maintenance purposes, Smart Launcher and any third-party services may collect files that record interaction with Smart Launcher (System logs) use other Personal Data (such as the IP Address) for this purpose.

Google Analytics for Firebase (Google Inc.)

Google Analytics for Firebase or Firebase Analytics is an analytics service provided by Google Inc. In order to understand Google’s use of Data, consult Google’s partner policy.Firebase Analytics may share Data with other tools provided by Firebase, such as Crash Reporting, Authentication, Remote Config or Notifications. This type of services allows you to visualize on your device current weather conditions. In order to provide this service the Application needs to retrieve your current position and transmit it to our weather providers partner services.

Open Weather Map

Open Weather Map is a service that providesPersonal Data collected: various types of Data as specified in the privacy policy of the service.

Infrastructure monitoring

This type of service allows this Application to monitor the use and behavior of its components so its performance, operation, maintenance and troubleshooting can be improved.Which Personal Data are processed depends on the characteristics and mode of implementation of these services, whose function is to filter the activities of this Application.

Firebase Crash Reporting (Google Inc.)

Firebase Crash Reporting is a monitoring service provided by Google, Inc.Personal Data collected: various types of Data as specified in the privacy policy of the service.

9. RETENTION TIME

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.

Therefore:

Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed. Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner. The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

10. PROTECTION OF MINORS

10.1 The user can exercise at any moment the rights set out in article 7 of the Privacy Code and in articles 15 and following of the GDPR, including the right to receive confirmation of the existence of personal data that concern him, to assess their content, accuracy, location (also with reference to any third Country), to ask for a copy of such data, to ask for the integration, update, correction and, when allowed by the applicable law, the restriction, cancellation, transformation in anonymous form or block for law infringement. This Application does not support “Do Not Track” requests.

10.2 Our Apps may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. 11. CHANGES TO OUR PRIVACY POLICY

The Owner reserves the right to make changes to this privacy policy at any time by giving notice to its Users on this page and possibly within Smart Launcher and/or – as far as technically and legally feasible – sending a notice to Users via any contact information available to the Owner.
