1. Who we are and what these Terms cover

Smart Launcher SRL, Via Scaloria 129, 71043 Manfredonia (FG), Italy. VAT number: IT04063240719 (“we”, “us”).

These Terms apply to Smart Launcher, Icon Pack Studio, Wallpaper Studio, Beaky, our websites, community features and any service that links to these Terms (the “Services”). Specific terms for a product, service or country take priority for that product, service or country.

Accepting. You accept these Terms when you use the Services, create an account, upload content or make a purchase. If you act for an organisation, you confirm that you can accept these Terms on its behalf.

Age. You must be at least 16. If you are under 18, you need a parent or guardian’s permission, including for purchases. A higher age requirement applies where your local law requires it.

Privacy. Our Privacy Policy explains how we handle personal data. Accepting these Terms does not replace consent where separate consent is required.

2. Your rights as a consumer

If you are a consumer, you keep all rights that applicable law gives you and that a contract cannot remove. These include rights relating to conformity, necessary updates, withdrawal, refunds and access to courts.

If any part of these Terms, including the limits on our responsibility or your responsibility to us, conflicts with those rights, your mandatory rights prevail. Google Play’s policies and our own refund policy do not replace them.

3. Using our apps

We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use our apps and Services under these Terms and applicable app-store rules. It is for your own use unless we agree otherwise in writing or a separate licence allows it.

Unless we give permission or the law allows it, you may not:

  • sell, rent, sublicense, redistribute or commercially exploit our apps, Services or paid features;
  • copy, modify, decompile, reverse engineer or extract the source code of our software;
  • distribute cracked, modified, unauthorised or pirated versions, or bypass paid features;
  • access other people’s accounts or data, bypass security, upload malware or disrupt the Services;
  • scrape or collect content or personal data with bots or other automated tools.

Use the Services lawfully. Do not harass, impersonate, deceive or harm others, or send spam and unauthorised promotions.

Official sources. Download our apps and updates only from sources we provide or approve. We are not responsible for unofficial copies, modifications or people pretending to represent us.

Data and permissions. Some features need an internet connection or device permissions. Your network provider may charge for data use.

4. Purchases

4.1 Paid features and subscriptions. Purchases are made through Google Play. Before payment, the purchase screen shows the product, price, billing period and renewal terms. Google Play’s payment, cancellation and refund rules also apply.

Subscriptions renew automatically at the current price until you cancel in Google Play. Cancellation takes effect at the end of the paid period. Price changes follow applicable law and Google Play’s rules, including any required notice or approval.

4.2 Lifetime licences. Unless the purchase screen says otherwise, a lifetime licence is a one-time, personal, non-transferable licence to the eligible paid features of the specific product you bought, for the lifetime of that product.

“Lifetime” means the period during which we continue to offer that product. It does not mean your lifetime or the lifetime of a device or third-party platform, or that every feature will stay available forever in its original form.

The licence covers the features included in your purchase and later updates that we choose to include. New features, products, services or paid options may be sold separately or offered under different terms.

We cannot promise compatibility with every future device, operating-system version, app-store requirement or third-party service. If compatibility is lost, we make reasonable efforts to provide continued access, a migration path, an equivalent alternative or another fair remedy, where technically and commercially reasonable.

Existing purchases. The rights included in your purchase are determined by the terms and product description that applied when you bought it. Later changes to these Terms do not reduce those rights.

4.3 Refunds and withdrawal. Under our own refund policy, you can request a refund within 14 days of purchase through our refund page. You can also request a refund through Google Play under its policies.

You may also have a legal right to withdraw from a purchase, usually within 14 days. If you ask for a service to start during that period, the law may allow a proportionate charge for the service already provided.

For digital content, the withdrawal right may end when delivery starts only if the legal conditions are met, including any required express consent, acknowledgement of the loss of that right and confirmation. Accepting these Terms alone does not waive your withdrawal right.

4.4 Conformity and updates. Our apps and paid features must meet applicable legal requirements. This includes working as promised and receiving the updates needed to remain in conformity.

If something does not work as it should, contact [email protected]. Depending on the law and circumstances, you may be entitled to a fix, a price reduction, a refund or an end to the contract.

Features marked as beta or experimental may be incomplete, change or be removed. This does not remove mandatory rights.

5. Changes to the Services and these Terms

We may update or change the Services and these Terms to fix errors, improve or add features, protect security, comply with law, maintain compatibility or change how we provide the Services. Updates may add, change or remove functions. We may also suspend or discontinue a Service, subject to your purchase rights and applicable law.

Notice. We give reasonable notice of material changes to these Terms. For material changes to the Services, we give reasonable notice where practical. Where the law requires it, we explain changes in advance and tell you about your options, which may include keeping an unchanged version where available, cancelling or receiving a refund. We obtain separate acceptance where required.

We make updated Terms available on our website or in our apps, with an effective or last-updated date. Continued use after they take effect means you accept them, subject to any legal requirement for separate acceptance. If you do not accept, stop using the affected Services and cancel any subscription where applicable. Later changes do not reduce rights included in earlier purchases.

Availability. We provide the Services with reasonable care, but cannot promise uninterrupted, error-free or always-secure access, or compatibility with every device or network. We may restrict access for maintenance, updates, security or abuse prevention.

6. Content you share

6.1 Ownership and permission. You keep ownership of the wallpapers, icon packs, themes, layouts, images, comments and other material you share (“User Content”).

When you share it, you give us a free, worldwide, non-exclusive licence to host, store, copy, display, publish, distribute and make it available to operate and improve the Services. This includes previews, resizing, format conversion, backups and other technical changes needed to store and deliver it.

Public content. You also allow us to make content you publish publicly available in our other apps and in partner products, including for download, and to use it to promote our Services, for example in screenshots, our website, store listings or social channels. We may grant partners the permissions needed for this distribution. These cross-product and promotional permissions do not apply to private or unlisted content.

Our service providers may use content on our behalf for the activities described here. To the extent allowed by law, you agree not to assert moral rights or similar rights in a way that prevents these authorised uses.

The licence ends within a reasonable period after you delete the content or your account. Copies may remain temporarily in routine backups, and copies already downloaded, stored or re-shared by others may remain outside our control.

6.2 Content processing. We may send content or parts of it, such as a preview or structured file, to third-party providers to generate metadata that improves presentation and discovery in the community and helps prevent abuse. Our Privacy Policy and third-party services page explain the related processing of personal data.

6.3 Your responsibility. Share only content for which you have the rights and permissions needed for the uses described above. You are responsible for your content and any infringement of copyright, trademarks, privacy or other rights.

Do not share content that is illegal, infringing, abusive, defamatory, discriminatory, misleading, fraudulent, obscene, invasive of privacy or otherwise unsuitable for the Services. This includes content that exploits minors, incites violence or hatred, impersonates others, reveals personal data unlawfully, distributes pirated materials, promotes scams or spam, or contains malware.

6.4 Reports and removal requests. Report content through our Content Removal Request page or at [email protected]. Include enough information to locate the content, explain the problem and provide relevant evidence and contact details. We may ask for more information. Do not knowingly send false, misleading or abusive reports.

6.5 Moderation and appeals. We may review, refuse, remove or limit content, or restrict accounts or access, if we believe content or behaviour breaks these Terms or the law, infringes rights, causes harm or creates legal, security or operational risk. We may use automated tools. We do not check all content in advance or guarantee that every violation will be detected.

Where required by law, we explain moderation decisions and available ways to challenge them. You can ask us to review a decision by writing to [email protected] and identifying the content or account concerned. Other legal remedies remain available. Serious or repeated violations may lead to temporary or permanent suspension.

7. Responsibility

7.1 Our Services and third parties. We provide the Services with reasonable care and skill. Beyond that commitment and rights that cannot be excluded by law, the Services are provided “as is” and “as available”, without other express or implied warranties, including warranties of quality, fitness for a particular purpose or non-infringement.

We cannot promise that the Services will meet every need or produce accurate results. User Content is supplied by users; we do not endorse or guarantee its accuracy, legality, quality or safety. Our responsibility for it is determined by applicable law.

Third-party apps, websites and services follow their own terms and policies. We do not control them or guarantee their content, availability or practices.

We are not responsible for failures or delays caused by events outside our reasonable control, such as network outages, natural disasters, cyberattacks, supplier failures or government action, subject to mandatory law.

7.2 Limits on liability. To the maximum extent allowed by law, Smart Launcher and its directors, officers, employees, contractors, affiliates, suppliers and licensors are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or lost profits, business, opportunities or data, business interruption or similar losses related to the Services.

Where liability cannot be excluded, it is limited to typical and foreseeable damage. To the maximum extent allowed by law, our total liability for claims related to the Services is limited to the higher of:

  • the amount you paid Smart Launcher for the affected Service in the three months before the claim; or
  • EUR 30.

These limits do not apply to liability that cannot legally be limited or excluded, including death or personal injury caused by negligence, fraud, intentional misconduct, gross negligence where applicable, or mandatory consumer rights.

7.3 Your responsibility to us. If your breach of these Terms, your User Content or your misuse of the Services causes claims, losses, damage, costs or expenses for Smart Launcher, you agree to compensate and defend us to the extent allowed by law.

This includes reasonable legal fees and costs arising from third-party claims relating to your content, infringement of others’ rights, unlawful conduct or breach of these Terms. We notify you of relevant claims where reasonably possible and let you take part in the defence, unless this creates a conflict of interest, legal risk or another reasonable concern.

8. Suspension and ending the contract

You can stop using the Services at any time. See Deleting your account or data to delete an account or request deletion of data. Cancel subscriptions separately in Google Play; deleting an account or uninstalling an app does not cancel them.

We may suspend or end access if you break these Terms, misuse the Services, infringe rights, harm others, create legal or security risk, or if the law requires it. We give notice and an opportunity to address the issue where appropriate and required by law.

We may discontinue a Service or feature. We give reasonable notice where practical and the change is material. Paid purchases remain subject to sections 4 and 5 and mandatory law.

Terms that need to continue after access ends remain in effect, including those on intellectual property, content licences, responsibility, compensation, governing law and disputes.

9. Our content and community channels

Our software, designs, names, logos, documentation and other materials belong to us or our licensors. These Terms give you a licence to use them, not ownership. Unless we give permission or the law allows it, you may not copy, modify, translate, publish, distribute, sell or otherwise exploit them, or remove ownership notices.

Our official social pages and groups run on third-party platforms under their own rules. We may moderate posts and participation to protect users and the purpose of those channels. Public channels are not suitable for private information or formal legal notices.

10. Law, other terms and contacts

Law and courts. Italian law governs these Terms. Italian courts have jurisdiction, except where mandatory consumer law gives you rights to bring claims elsewhere. Consumers keep the mandatory protections of their country of residence.

Other terms. You may not transfer your rights or obligations without our written permission. We may transfer ours, for example in a merger or sale of the Services, and give notice where required by law if this materially affects your rights. If a clause cannot be enforced, the rest remains in effect. Not enforcing a right does not waive it; any waiver must be in writing. These Terms do not give rights to third parties unless expressly stated or required by law.

Comply with applicable export-control and sanctions laws. Do not use the Services where those laws prohibit it.

Notices. We may contact you by email, in-app message, website notice, push notification or another reasonable method.
